Filing a Personal Injury Claim
Personal injury claims can arise from a variety of circumstances, including automobile mishaps, premises liability, railroad grade crossings, airplane crashes and any number of other situations where traumatic injury occurs as a result of the fault of others. Filing a personal injury claim can be complex. Hepworth, Janis, & Kluksdal, CHTD, in Boise, ID, is here to help.
Personal injury claims in Idaho must be filed within two years of the occurrence. If you have been hurt by someone else’s negligence, you can receive compensatory damages, including economic losses for past and future medical expenses, loss of wages and impaired earning capacity, plus non-economic damages for past and future pain and suffering, disability, disfigurement and lost enjoyment of life.
There is no limit on the amount of economic losses recoverable; however, non-economic losses may be limited by statute to approximately $300,000 unless special circumstances exist which make the non-economic damage cap inapplicable to your case.
If you have been involved in a personal injury claim, there are several steps you should take, including:
- Obtaining a copy of the police or incident report, including any witness statements obtained by police authorities.
- Taking multiple photographs of the site of the mishap and of the individuals involved, including their injuries.
Starting a journal to record how the injuries are affecting your life, work and other daily activities.
Things you should not do include:
- Do not give a written or recorded statement to any insurance adjuster;
- Do not sign any documents, including any medical release involving your claim; and
- Do not discuss how the mishap occurred with others.
